agreement to terms

By accessing or using the Monday Draft website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms constitute a legally binding agreement between you and Monday Draft LLC ("Monday Draft," "we," "us," or "our").

description of services

Monday Draft provides hyper-local content marketing services for local businesses, including but not limited to: blog post creation, social media content, email campaign writing, local SEO keyword strategy, and Google Business Profile management. Services are delivered on a recurring subscription basis, with content packages delivered weekly.

accounts and registration

To access certain features of our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

billing & payment

Subscription fees are billed monthly in advance. All prices are listed in US dollars. By subscribing to a plan, you authorize Monday Draft to charge your payment method on a recurring monthly basis until you cancel.

• You are charged immediately at signup.There is no free trial. Your first invoice is discounted 25% as a welcome offer ("first week free" — equivalent to 25% off one month of service). After your first month, you are billed the full monthly rate.
• Payment is processed securely through Stripe. We do not store your credit card information directly.
• Subscription fees are non-refundable except as required by law. If you cancel mid-cycle, you will continue to receive services through the end of your current billing period.
• We reserve the right to change our pricing with 30 days' written notice. Price changes will take effect at the start of your next billing cycle.
• Failed payments may result in service suspension. We will attempt to notify you before suspending access.
• There are no contracts. You may cancel at any time from your dashboard or by emailing hello@mondaydraft.com.

cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. Upon cancellation, you will retain access to your content dashboard and previously delivered content. We reserve the right to delete account data 90 days after cancellation.

intellectual property

Content delivered through our services:

• Your content: Once delivered and paid for, all content we create for your business becomes your property. You are free to use, modify, and distribute it as you see fit.
• Our platform: The Monday Draft website, brand, design, code, and proprietary tools remain our intellectual property. You may not copy, modify, distribute, or create derivative works based on our platform.
• Feedback: Any suggestions or feedback you provide about our services may be used by us without obligation to you.

acceptable use

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws
• Provide false or misleading information about your business
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use our services to generate content that is defamatory, obscene, or harmful
• Resell or redistribute our services without written authorization

limitation of liability

To the maximum extent permitted by law, Monday Draft and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of revenue, loss of profits, loss of business, or loss of data. Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid to Monday Draft in the twelve (12) months preceding the claim.

disclaimer of warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or that content will achieve specific marketing results. While we strive to create high-quality, effective content, marketing outcomes depend on many factors beyond our control.

indemnification

You agree to indemnify and hold harmless Monday Draft and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of our services, your violation of these terms, or your violation of any rights of a third party.

governing law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Maryland. You consent to the personal jurisdiction of such courts.

changes to these terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by posting the updated terms on our website and updating the "last updated" date. Your continued use of our services after any changes constitutes your acceptance of the updated terms.
